By accessing or using GlowUp Apps (“Services”), including any of our Shopify-integrated apps and related websites or applications, you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Services.
Glowup Apps provides Shopify users with apps designed to enhance the functionality and performance of their online stores. By accessing our website or installing our apps, you acknowledge that you have read, understood, and agreed to these Terms.

2. Use of Services

• Permitted Use: You may use the Services for lawful purposes only. You are responsible for all activities that occur under your account.
• Prohibited Use: You agree not to:
  • Use the Services for any illegal or unauthorized purpose.
  • Interfere with the security or integrity of the Services.
  • Use any automated means, including scripts, robots, or crawlers, to access or interact with the Services.
  • Attempt to gain unauthorized access to any portion of the Services or any accounts other than your own.
  • Use the Services in a way that could harm, disable, or overburden the Services.
  • Collect or store personal information about other users without their consent.
  • Violate any applicable laws or regulations.

3. Intellectual Property

The Services and all related content, including but not limited to trademarks, logos, designs, text, graphics, and software, are the intellectual property of GlowUp Apps or its licensors and are protected by copyright, trademark, and other intellectual property laws. The Services are provided “as is” and “as available” without any warranties, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

5. Limitation of Liability

In no event shall GlowUp Apps be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of or inability to use the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount paid by you, if any, for the use of the Services in the six (6) months prior to the date of the claim.

We may suspend or terminate your access to our Services at any time if you violate these Terms or for other reasons, including technical issues.

7. Fees and Payments

• Our app integrates with Shopify’s payment system for seamless transactions. To access and use our services, you are required to subscribe to a plan. All fees associated with the subscription are non-refundable.
• Payments are processed securely via Shopify, and by subscribing, you agree to their payment terms and conditions. You may cancel your subscription at any time; however, cancellation will not entitle you to a refund for any fees already paid.

8. Indemnification

You agree to indemnify and hold harmless GlowUp Apps and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or relating to your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United State without regard to its conflict of law provisions.

10. Dispute Resolution
